Terms & Conditions – WordPress Maintenance Service
The following terms and conditions (“terms”) constitute the details of the agreement (“contract”) between Owen Lewis Design (“us”, “we” “supplier”, “service provider”) and you (“the client”, “website owner”), for Owen Lewis Design to carry our regular maintenance and appropriate updates for a single WordPress installation (“the website”).
Update Installation
All available updates for the WordPress core, active themes and active plugins will be installed either weekly, monthly, or quarterly as per the selected contract frequency. Updates are provided by thrid party service providers and therfore we cannot guarantee the effect they will have on your website or take responsibility for the contents.
Frequency
The work will be carried on the first available working day on or after the scheduled date as it falls within the calendar year and fequency of your contract.
Backups
As part of the agreement Owen Lewis Design will install and configure UpDraft Plus to take regular automated backups of your website. We may also run manual backups before installing specific updates as an extra precaution. Backups may be stored locally on the hosting server, but it recommmended the client supplies access to an external storage service (e.g Google Drive) to store off-site backups. All backups are generated and stored using third party products and services, therefore Owen Lewis Design does not make any guarantees or take responsibility for the validity or availability of backups at any time.
Downtime
In the vast majority of cases downtme can be avoided entirely when installing updates. Occasinally it may be neccessary to put the website into maintenance mode to install updates and/or the site may expierence tempoary loss of service during update installation. It is the reponsibility of the client to notify Owen Lewis Design of any important dates or times that should be avoided when installing updates or working on the website.
Incompatibility
Occassionally, some plugins or themes may expierence incompatibility with other aspects of your website. In this instance we will offer advice on the best course of action where possible, but some updates may never be possible and an alternative product or service way be needed. Owen Lewis Design are not responsible for compatibility issues.
Customisations, File Templates and Child Themes
Installing updates can sometime overwrite bespoke customisation if it has not been correctly implemented. To avoid this we strongly recommend all customisation is contained within a child theme or bespoke plugin and are not responsible for any overwitten changes by third party developers. Occassionally child templates can become outdated in line with the parent theme. Where possible, we will seek to recreate outdated template files to retain customisations in the latest template format, but this may require additonaly work outside the scope of this agreement. If additonal work is required we will provide a fixed quote for your approval before making any changes.
Multiple Websites
This agreement covers a single WordPress website. To utilise this service for multiple websites a separate contract must be created for each one. For WP Multisite Installs, this contract will cover updates at the ‘Network Admin’ level and where possible some minor updates to subsites may be carried out. If regular updates to multiple subsites with different configurations is required, then a separate contact for each subsite should be created.
Fees
Owen Lewis Design reserves the right to change fees for this service at any time. We will always attempt to give you fair notice of any fee increases and you have the right cancel your contract at any time as per the cancellation terms defined below.
Payment
Payment is taken on a pro rata basis in line with the selected contract frequency, via direct debit using GoCardless. Payments will appear on your bank statement as GoCardless Ltd with the payment reference OWEN LEWIS. Failed or returned payments will plave your contract on hold until any outstanding amounts are cleared and repeated failures to pay will result in your contract being cancelled in line with the cancellation terms defined below.
Cancellation
Either party has the right to cancel this agreement at any time. To cancel your contract simple write to info@owen-lewis.com stating the relevant website address for the contract to be cancelled. Cancellation will take immediate effect and no further payments will be taken or work carried out.
